Dosarul FLOTA \u2013 Remember<\/em><\/h3>\n

130 de oameni cercet\u0103ti, 80 de acuza\u021bi, niciun prejudiciu rezultat \u00een urma v\u00e2nz\u0103rii pe nimic a 16 nave. Dosarul \u201eFlota\u201d intra \u00een galeria marilor fraude economice ale sf\u00e2r\u0219itului de secol XX. Era perioada \u00een care Romania a ie\u0219it din \u201eepoca de aur\u201d \u0219i a intrat \u00een \u201eepoca \u021bepelor\u201d. \u201eFinanciarul\u201d va propune \u00een fiecare s\u0103pt\u0103m\u00e2na cate un dosar celebru, cu \u201eautor necunoscut\u201d. Ast\u0103zi, despre cum au disparut \u201ef\u0103r\u0103 urm\u0103\u201d 286 de nave.Odat\u0103, demult, Romania \u201einventa\u201d exploatarea la scar\u0103 industrial\u0103 a petrolului, n\u0103scocea primul avion cu reac\u021bie sau era intre primele trei \u021b\u0103ri care utilizau laserul \u00een industrie. Ei bine, am fost mai mult dec\u00e2t at\u00e2t, vorba poetului \u00een via\u021b\u0103 \u2013 am avut \u0219i a nou\u0103 flot\u0103 maritim\u0103 (comercial\u0103) a lumii. O tempora, o mores\u2026<\/h4>\n

La ora actual\u0103, din toat\u0103 flota rom\u00e2neasc\u0103 nu mai exist\u0103 decat un munte de dosare penale care plute\u0219te prin tribunalele patriei.<\/h4>\n

Prea multe nave<\/em><\/h3>\n

Revolu\u021bia din decembrie 1989, sau cum vreti s\u0103-i spune\u021bi, ne-a prins cu 286 de nave \u00een stare de func\u021bionare, toate aflate \u00een dotarea flotei maritime comerciale. Ele se aflau \u00een administrarea fostei \u00eentreprinderi de stat Navrom Constan\u021ba. Asa cum am mai spus, dar ar fi bine s-o repet\u0103m de mai multe ori pe parcursul acestui material, \u00een topul mondial al flotelor comerciale Rom\u00e2nia ocupa atunci locul 9.\n\u00cens\u0103 o minte luminat\u0103 s-a g\u00eendit c\u0103 o asemenea armat\u0103 era de neconceput \u0219i greu de condus, a\u0219a c\u0103, la data de 15 mai 1990, intreprinderea de stat a fost spart\u0103 \u00een trei companii: Navrom, Romline \u0219i Petromin. Dintre acestea, Petromin a primit 89 de nave de cel mai mare tonaj, devenind segmentul strategic al flotei comerciale. Director general al companiei a fost numit Calin Marinescu, zis \u201e\u0218ogunul\u201d. Trebuie spus c\u0103, din cele 286 de nave, cel pu\u021bin 90 se aflau \u00een diferite stadii de degradare, scoaterea lor din uz fiind mai mult dec\u00e2t recomandat\u0103. R\u0103m\u00e2n, totu\u0219i, mai mult de 190 de nave maritime bune \u0219i foarte bune care au disp\u0103rut f\u0103r\u0103 urm\u0103.<\/h4>\n

Fructul pasiunii<\/em><\/h3>\n

Pentru c\u0103 avea vapoare mai multe \u0219i mai bune, Petromin a st\u00e2rnit, la vremea ei, dorin\u021bele multor afaceri\u0219ti, din tara \u0219i din strainatate. \u0218i, a\u0219a cum se \u00eentampl\u0103 cu orice lucru de care trage toata lumea, din compania \u00een cauz\u0103 s-a ales praful, \u00een doar opt ani. R\u00e2nd pe r\u00e2nd au disparut toate navele \u2013 unele v\u00e2ndute pe un dolar, altele sechestrate prin porturile lumii \u00een contul unor datorii neachitate. Sigur, v\u0103 tot \u00eentreba\u021bi de ani buni, ca \u0219i \u00een alte cazuri, cine sunt vinova\u021bii.\nA existat \u0219i o ancheta penal\u0103, menit\u0103 a face lumin\u0103 \u00een toat\u0103 afacerea. S-a finalizat cu un dosar, celebru, \u201eFlota\u201d pe numele lui. Personajul principal era Traian B\u0103sescu, \u00een calitatea sa de ministru al transporturilor \u00een momentul \u00een care navele au \u00eenceput s\u0103 intre \u00een\u2026 \u201eTriunghiul Bermudelor\u201d. Nu era singurul suspect, ci a f\u0103cut \u201eechipa\u201d cu alti 80 de  acuza\u021bi.<\/h4>\n

\"\"<\/h4>\n

\nAcuzat de propria putere<\/em><\/h3>\n

\u201eFinanciarul\u201d v\u0103 prezint\u0103 dosarul \u201eFlota\u201d asa cum a ie\u0219it el pentru prima oara din \u201emalaxorul\u201d anchetatorilor. Ve\u021bi vedea c\u0103 multe dintre deciziile luate de oficiali guvernamentali fa\u021b\u0103 de navele rom\u00e2nesti au fost pur \u0219i simplu stupide, asta ca s\u0103 ne exprim\u0103m ginga\u0219. Altele pot fi catalogate drept r\u0103u inten\u021bionate. R\u0103m\u00e2ne ca dumneavoastr\u0103 s\u0103 judeca\u021bi, pentru c\u0103 instan\u021ba a decis c\u0103 nu exist\u0103 niciun prejudiciu \u00een toat\u0103 afacerea.\nRe\u021bine aten\u021bia faptul c\u0103 dosarul ce \u00eel \u00eencrimineaz\u0103 pe Traian B\u0103sescu de \u201escufundarea\u201d flotei rom\u00e2ne\u0219ti \u2013 cazul Petromin \u2013 nu a fost deschis de adversarii politici din PSD, ci de colegi din Partidul Democrat, chiar pe vremea c\u00e2nd Traian B\u0103sescu se afla la putere. Instrumentat pentru prima oar\u0103 \u00een 1999 (procuror general era chiar Mircea Criste, un fost membru PD), dosarul \u00eel acuza pe Traian B\u0103sescu  de faptul c\u0103, \u00een 1991, \u00een calitate de ministru al transporturilor, a semnat celebrul contract de asociere cu firma norvegian\u0103 \u201eKlaveness\u201d c\u0103reia, practic, i-au fost v\u00e2ndute 16 nave maritime cu un dolar bucata. \u00cen urma acestui contract, partea rom\u00e2n\u0103 s-a ales f\u0103r\u0103 nave, dar \u0219i cu datorii de aproximativ 20 de milioane de dolari la o banca din Oslo.<\/h4>\n

Capetele de acuzare<\/em><\/h3>\n

Acuzatiile au fost constituite pe baza verificarilor facute de Directia Generala a Controlului Financiar de Stat la Compania de Navigatie Maritima Petromin SA Constanta. In dosar sunt consemnate urmatoarele ilegalitati: \u201eIn toate cazurile, infiintarea companiilor din strainatate (ale Petromin \u2013 n.r.) nu au avut aprobarea Guvernului Romaniei asa cum prevad dispozitiile Decretului-lege nr. 104 din 30 martie 1990.\nDocumentele de infiintare si functionare a acestor companii au fost aprobate de Basescu Traian \u2013 ministrul transporturilor. Navele apartinand Petromin SA Constanta au arborat pavilion liberian tot prin ordin al ministrului transporturilor, incalcandu-se astfel dispozitiile Decretului nr. 443\/1972, ramas in vigoare pana la aparitia Ordonantei  Guvernului Romaniei nr. 42 din 29 august 1997, cand a fost abrogat in mod expres de guvernarea CDR.  Prejudiciul produs Petromin SA Constanta prin managementul necorespunzator in perioada 1991-1999 este estimat la peste 150 de  milioane de dolari\u201d.<\/h4>\n

Falimentul profitabil. Pentru cine?<\/em><\/h3>\n
\n

Petromin a disparut \u00een urma unor decizii menite a o face profitabil\u0103. Cel putin a\u0219a au sus\u021binut cei implicati \u00een afacere, \u00een frunte cu Traian B\u0103sescu. Potrivit documentelor de la Parchet, \u00een baza unei note a Ministerului Transporturilor (f\u0103r\u0103 num\u0103r \u0219i dat\u0103), pe 31 martie 1991 s-a stabilit necesitatea ob\u021binerii unui credit de 45 de milioane de dolari pentru  retehnologizarea a 15 nave apar\u021bin\u00eend Petromin. Peste nici dou\u0103 s\u0103pt\u0103m\u00e2ni, pe 11 aprilie, Traian B\u0103sescu, \u00een calitate de ministru al transporturilor, semna la Oslo, \u00eempreun\u0103 cu reprezentan\u021bii Petromin \u0219i ai firmei norvegiene Klaveness, o scrisoare de inten\u021bie prin care se convenea \u00eenfiin\u021barea unei companii mixte romano-norvegiene, cu sediul \u00een Liberia, pentru exploatarea a 16 nave rom\u00e2nesti. Condi\u021bia era ca partea norvegiana s\u0103 asigure ob\u021binerea acelui credit de 45 de milioane de dolari necesar retehnologizarii navelor.<\/h4>\n<\/div>\n

<\/h4>\n

Ministru \u0219i director<\/em><\/h3>\n

Zis \u0219i f\u0103cut. La data de 14 mai 1991 s-a hot\u00e2rat \u00eenfiin\u021barea companiei mixte Petroklav, cu sediul \u00een Liberia. Ulterior, s-a renuntat la aceast\u0103 loca\u021bie, societatea fiind \u201emutat\u0103\u201d \u00een Bahamas, la data de 26 iulie 1991. Toate aceste demersuri au fost aprobate de ministrul Traian B\u0103sescu, f\u0103r\u0103 ca acest\u0103, sustine Parchetul, s\u0103 ob\u021bin\u0103 \u0219i aprobarea Guvernului Rom\u00e2niei, a\u0219a cum prevedea legisla\u021bia. De asemenea, navele din respectivele companii, care apar\u021bineau Petromin, au arborat pavilion liberian tot prin ordin al ministrului B\u0103sescu, de\u0219i dispozi\u021biile \u00een vigoare la acea vreme interziceau acest lucru. Managementul era \u00eencredin\u021bat prin contract firmei Klavenes\u201d. \u00cen schimb, norvegienii s-au \u021binut de cuv\u00e2nt, au ob\u021binut de la Christiania Bank din Oslo dou\u0103 credite \u00een valoare de 45 \u0219i, respectiv,  64 de milioane de dolari, \u00eemprumuturi garantate cu navele rom\u00e2ne\u0219ti. \u0218i pentru ca activitatea era a\u0219a de profitabil\u0103, p\u00e2n\u0103 \u00een 1999, pentru a pl\u0103ti ratele creditului total de 109 milioane de dolari, au fost v\u00e2ndute zece din cele 16 nave cu care Petromin s-a asociat cu partenerul norvegian. \u00cens\u0103 ghinion, mai r\u0103m\u0103sesera de platit 20 de milioane de dolari. A\u0219a c\u0103 \u0219i celelalte \u0219ase nave s-au aflat \u00een situa\u021bia de a fi arestate \u0219i v\u00e2ndute pentru ipoteca f\u0103cut\u0103 de Christiania Bank. Potrivit datelor din dosarul \u201eFlota\u201d, compania Petromin nu a \u00eencasat niciun dolar din milioanele realizate de firma mixta romano-norvegiana \u00een toat\u0103 perioada 1991-1999. Iar ca tot circul s\u0103 fie complet, s-a descoperit c\u0103 \u00een firma mixt\u0103  constituit\u0103 cu norvegienii,  Traian B\u0103sescu a figurat ca director cand era \u0219i ministru al transporturilor.<\/h4>\n

\u201eDin shipping nu se c\u00e2stig\u0103. Se pierde\u201d<\/em><\/h3>\n

Traian B\u0103sescu a sus\u021binut \u00eentotdeauna ca navele implicate \u00een contractul cu firma Klaveness au fost v\u00e2ndute formal cu un dolar c\u0103tre o firm\u0103 str\u0103in\u0103 la care asociat  unic era Petromin, pentru c\u0103 era obligatoriu acest lucru, deoarece o parte din nave reprezentau garan\u021bii suplimentare la creditul de 49 de milioane de dolari (de\u0219i \u00een dosar figureaz\u0103 un credit de 45  de mil. de dolari \u2013 n.r.). Niciodat\u0103 nu a avut inten\u021bia de a \u00eenstr\u0103ina navele, iar dovada cea mai buna era, \u00een viziunea actualului pre\u0219edinte, faptul c\u0103 ele au ramas \u00een inventarul Petromin, cu cheltuieli de amortisment. Vizavi de faptul c\u0103 s-a \u00eencredin\u021bat managementul unei alte firme nu pare a fi nicio problem\u0103 pentru anchetatori at\u00e2ta timp cat firma romaneasc\u0103 avea 50% din ac\u021biuni. R\u0103mane \u00eensa o \u00eentrebare, dac\u0103 era a\u0219a de bun contractul \u00eencheiat cu Klaveness, de ce Rom\u00e2nia \u0219i-a pierdut navele \u0219i a r\u0103mas \u0219i cu datorii externe foarte mari? \u00cen urm\u0103 cu aproape cinci ani (mai 2003), Traian B\u0103sescu declara presei c\u0103 \u201edin shipping nu se c\u00e2stig\u0103. Se pierde. Asta am aflat-o \u00een 1995 de la norvegieni, c\u00e2nd am c\u00e2\u0219tigat o burs\u0103 \u0219i m-am specializat acolo. Eram \u0219i parlamentar, dar mergeam \u0219i la \u0219coal\u0103. Ca s\u0103 faci bani cu nave trebuie s\u0103 \u0219tii c\u00e2nd s\u0103 le cumperi \u0219i c\u00e2nd s\u0103 le vinzi. Noi n-am avut a\u0219a o flot\u0103 puternic\u0103 \u0219i bun\u0103, cum se sus\u021bine. Era uzat\u0103 sau prost f\u0103cut\u0103, pentru c\u0103 Ceau\u0219escu, \u00een ultimii zece ani, a \u021binut mor\u021bis s\u0103 fac\u0103 toate piesele \u00een Rom\u00e2nia. Nu au fost scoase la v\u00e2nzare de fric\u0103, s\u0103 nu se aleag\u0103 cu dosar penal. Eu, ca ministru, nu puteam s\u0103 m\u0103 ocup de a\u0219a ceva. De astfel de lucruri trebuiau s\u0103 se ocupe Consiliul \u00cemputernici\u021bilor Statului \u0219i, din 1992, FPS-ul. Nu am fost directorul firmei mixte cu norvegienii, am fost presedintele onorific al consiliului de administra\u021bie. Pentru o astfel de func\u021bie onorifica nu esti pl\u0103tit. Eu n-am fost pl\u0103tit de norvegieni. Am auzit c\u0103 mi-au c\u0103utat \u0219i conturi \u00een str\u0103inatate. N-au g\u0103sit, c\u0103 n-au ce s\u0103 g\u0103seasc\u0103. Totul este politic. Au \u00eencercat \u0219i \u00een 1993, a \u00eencercat \u0219i Emil Constantinescu s\u0103 m\u0103 \u00eenfunde. Acum se \u00eencearc\u0103 din nou. Am mai auzit c\u0103 au pus un expert \u2013 Nicu Oprea \u2013 s\u0103 fac\u0103 asta, pentru ca el avea un dosar penal. Acum, acest Oprea nu mai este \u00een \u021bar\u0103. A f\u0103cut expertiza \u0219i a fost l\u0103sat s\u0103 plece. A\u0219a am auzit. Nu sunt vinovat \u0219i nici nu m\u0103 intimideaza cu dosarul lor\u201d.<\/h4>\n

\u0218i totu\u0219i, unde sunt vapoarele?<\/em><\/h3>\n

Traian B\u0103sescu a fost sau nu vinovat, asta nu o vom afla niciodat\u0103. La un moment dat \u00eens\u0103, a sc\u0103pat o pista foarte interesant\u0103 c\u0103tre anchetatori. El a declarat c\u0103 navele cele mai bune din contractul cu Klaveness au ajuns la un membru PSD \u0219i la un t\u0103r\u0103nist. \u201eS-au b\u0103tut pentru ele. Ei le-au cump\u0103rat\u201d, declara Traian B\u0103sescu.\nNiciuna dintre institutiile statului nu a mers pe aceast\u0103 idee, a g\u0103sirii \u201ecorpului delict\u201d. Surse politice ne-au confirmat \u00eens\u0103 par\u021bial declara\u021biile din urm\u0103 cu cinci ani, f\u0103cute de actualul pre\u0219edinte. Cel putin 25 dintre navele Petromin apar\u021bin unor armatori rom\u00e2ni, acum importan\u021bi oameni de afaceri \u00een jude\u021bul Constan\u021ba.\nConcluzia este una trist\u0103 pentru noi, hilar\u0103 pentru cineva \u201edin afar\u0103\u201d. Aproape 300 de nave au disparut, dar nimeni nu este vinovat. Nu exist\u0103 prejudiciu, nu exist\u0103 fapt\u0103 penal\u0103. Pentru amuzamentul dumneavoastr\u0103 s\u0103 v\u0103 pomenim despre cazul unui \u0219ef de serviciu la Navrom, acuzat de  abuz \u00een serviciu, fals intelectual \u0219i uz de fals. \u00cen timp ce era cercetat penal a reu\u0219it performan\u021ba s\u0103 devin\u0103\u2026 director economic la Penitenciarul Poarta Alb\u0103, cu gradul de maior. Justi\u021bia rom\u00e2n\u0103 poate fi m\u00e2ndr\u0103 c\u0103, asemenea savan\u021bilor care au cutreierat Triunghiul Bermudelor, a emis doar teorii judiciare. Lipse\u0219te doar ipoteza extratere\u0219trilor \u0219i a por\u021bii c\u0103tre o alt\u0103 lume\u2026<\/h4>\n

Romline \u0219i Navrom, giran\u021bi pentru SRL-uri<\/em><\/h3>\n

Companiile na\u021bionale maritime Romline \u0219i Navrom au fost mult timp \u0219i principalii datornici afla\u021bi pe lista Agen\u021biei pentru Valorificarea Activelor Bancare (AVAB) care preluase problemele Bancorex. Astfel s-a ajuns \u0219i la declan\u0219area falimentului celor dou\u0103 companii pentru a se putea recupera sume c\u00e2t mai mari prin arestarea \u0219i executarea navelor care umblau hai-hui pe oceanele lumii. Romline \u0219i Navrom au avut calitatea de codebitor pentru un mare numar dintre creditele luate de  diverse  firme de la Bancorex. De exemplu, Navrom a garantat cu nave proprii creditele ob\u021binute de 27 de societa\u021bi private, iar pentru 11 companii private a preluat integral datoriile rezultate din creditele luate de la Bancorex.\n\u0218i Romline a garantat cu navele proprii creditele ob\u021binute de \u0219ase companii private de shipping, pentru trei dintre acestea prelu\u00e2nd integral datoriile rezultate din conven\u021bii de credit \u00eencheiate cu Bancorex. De altfel, multe credite au fost luate de la Bancorex de niste SRL-uri ce aveau denumirea \u201eshipping\u201d \u00een coad\u0103, dar care nu aveau flot\u0103 proprie, ci foloseau nave \u00eenchiriate.<\/h4>\n
